Terms of Service

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services provided by Maple Grove Garden Co. (“Maple Grove Garden Co.,” “we,” “us,” or “our”), including any related communications, estimates, proposals, invoices, and service arrangements.
By requesting, scheduling, purchasing, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms apply to all customers, property owners, tenants, property managers, and other persons who engage Maple Grove Garden Co. for services.
2. Scope of Services
Maple Grove Garden Co. provides garden and landscape-related services, which may include, without limitation:
- Garden design and planning
- Seasonal planting and flower bed installation
- Lawn care and edging
- Pruning and shrub maintenance
- Mulching and soil conditioning
- Weed control and bed cleanup
- Spring and fall garden cleanups
Any service description, estimate, proposal, or schedule provided by Maple Grove Garden Co. is intended for planning purposes only and may be adjusted based on site conditions, weather, material availability, safety considerations, and customer instructions.
We reserve the right to decline or discontinue any service request that, in our reasonable judgment, is unsafe, impractical, unlawful, or outside our operational capabilities.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and current information when requesting services.
- Ensure that you have the legal right, authority, or permission to authorize work on the property.
- Disclose any known hazards, underground utilities, irrigation systems, drainage issues, pests, allergies, pet concerns, or other site-specific risks.
- Remove or secure valuables, fragile items, personal property, and obstacles from work areas before service begins.
- Provide safe and reasonable access to the property, including gates, driveways, water access, and any necessary entry instructions.
- Obtain any required permits, approvals, or consents unless otherwise agreed in writing.
- Comply with all applicable municipal, provincial, and federal laws, bylaws, and regulations.
You acknowledge that garden and landscape work may involve living materials, seasonal variability, and environmental factors beyond our control. Results may vary depending on weather, soil conditions, plant health, and maintenance after service completion.
You are responsible for following any care instructions we provide after service, including watering, fertilizing, mowing, trimming, and pest monitoring where applicable.
4. Payment Terms and Conditions
Unless otherwise agreed in writing, fees for services are due in accordance with the estimate, invoice, or service agreement provided by Maple Grove Garden Co.
- Prices may be quoted as fixed fees, hourly rates, or time-and-materials charges, depending on the scope of work.
- Estimates are based on information available at the time of quotation and may change if site conditions, scope, or materials differ from what was disclosed.
- Additional work requested by you, or required due to unforeseen conditions, may result in extra charges.
- We may require a deposit, progress payment, or full prepayment for certain services, materials, or seasonal bookings.
- Invoices are payable by the due date stated on the invoice. Late payments may be subject to interest or administrative charges to the extent permitted by law and disclosed in advance.
- You are responsible for all applicable taxes, including GST/HST, unless otherwise stated.
If payment is not received when due, we may suspend or cancel services, withhold future bookings, and pursue any lawful remedies available to us.
5. Cancellation and Refund Policy
You may cancel or reschedule a service by providing reasonable notice. Cancellation terms may vary depending on the type of service, materials ordered, and scheduled labour.
- For scheduled services, cancellations made with sufficient notice may be eligible for a full or partial refund, less any non-recoverable costs already incurred.
- Deposits may be non-refundable where materials have been purchased, labour has been reserved, or custom planning work has begun, unless otherwise required by law.
- If we must cancel or reschedule due to weather, safety concerns, supply issues, or other operational reasons, we will make reasonable efforts to offer an alternative date.
- Refunds, if approved, will be processed using the original payment method where practicable.
Because many of our services involve labour, perishable materials, and site-specific work, completed services are generally non-refundable except where required by applicable law or expressly agreed in writing by Maple Grove Garden Co.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Grove Garden Co. shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of use, loss of enjoyment, loss of profits, or loss of data, arising out of or related to our services or these Terms.
Without limiting the foregoing, we are not responsible for:
- Pre-existing property damage, soil conditions, drainage issues, pest infestations, disease, or plant failure not caused by our gross negligence or wilful misconduct.
- Damage resulting from hidden or undisclosed hazards, including underground utilities, irrigation lines, cables, or structures.
- Damage caused by extreme weather, acts of nature, third parties, animals, vandalism, or improper post-service care.
- Delays or service interruptions caused by events beyond our reasonable control.
To the extent permitted by law, our total aggregate liability for any claim arising from or relating to the services shall not exceed the amount paid by you to Maple Grove Garden Co. for the specific service giving rise to the claim.
Nothing in these Terms limits liability where such limitation is prohibited by law, including liability for gross negligence, wilful misconduct, or any other liability that cannot lawfully be excluded under applicable Canadian law.
7. Intellectual Property Rights
Unless otherwise agreed in writing, all intellectual property rights in our designs, plans, concepts, drawings, estimates, photographs, written materials, and other deliverables created by Maple Grove Garden Co. remain our property until full payment has been received, to the extent permitted by law.
Upon full payment, you receive a non-exclusive, non-transferable licence to use the deliverables solely for the property and purpose for which they were created. You may not reproduce, resell, distribute, or use our materials for other properties or commercial purposes without our prior written consent.
Any trademarks, logos, trade names, or branding associated with Maple Grove Garden Co. remain our exclusive property.
8. Data Protection and Privacy
Maple Grove Garden Co. collects, uses, and discloses personal information only as reasonably necessary to provide services, communicate with you, process payments, manage bookings, maintain records, comply with legal obligations, and improve our operations.
We take reasonable administrative, technical, and physical safeguards to protect personal information in our custody or control. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
By using our services, you consent to our collection, use, and disclosure of personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
If you provide personal information about another person, you represent that you have the authority to do so and to permit us to use that information as contemplated by these Terms.
9. Force Majeure
Maple Grove Garden Co. shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including but not limited to severe weather, storms, flooding, fire, labour disputes, supply shortages, transportation disruptions, power outages, government actions, public health emergencies, or acts of God.
In the event of force majeure, we may suspend, reschedule, or modify services without liability, and we will use reasonable efforts to resume performance as soon as practicable.
10. Changes to Terms
We may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The revised Terms will be effective when posted or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after any changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms and any dispute arising out of or relating to them, or to the services provided by Maple Grove Garden Co., shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in Ontario, Canada shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or related to these Terms or our services, subject to any mandatory consumer protection rights or other non-waivable rights under applicable law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Any invalid or unenforceable provision shall be interpreted, where possible, to reflect the original intent of the parties and to remain enforceable to the fullest extent permitted by law.
